Jose Augustin Marquez and Jose Arturo Ramirez were both in court Wednesday, tied to a 2009 car accident in which 21-year-old Rudy Natal was killed.

Both are facing second degree murder charges, along with several other felony charges.

Police say Ramirez was the driver in the one vehicle accident.

Officers say he lost control and drove into a brick wall, when Natal was thrown from the vehicle and was pronounced dead at the scene.

Lawyers for Marquez were unaware of any charges pending against him.

“"Your honor as far as I know there are no pending charges,” said his lawyer. It was an arrest made without a warrant. It is a matter in which my client was a passenger in a vehicle, and there was accident, and someone was killed. He was a passenger."

While state prosecutors did not appear in court, deputies from the sheriff’s department were present at the hearing.

The victim’s parents did appear in court, making their case that both Ramirez and Marquez be released from custody, saying that charging them for their son’s murder will not bring him back.

The judge granted standard conditions of release to both suspects.
